These Terms & Conditions apply to the use and purchase of Nova Code Matrix software, digital products, business software and financial-data comparison tools and related services.
Digital Products, Downloads and Cancellation
Digital products and software may be made available for download or access after successful payment.
Where the customer requests immediate supply of digital content, the customer will be asked to expressly consent to the supply beginning before the end of the applicable cancellation period and to acknowledge the loss of the statutory right to cancel once supply has begun, where permitted by applicable law.
This does not affect the customer’s statutory rights if the software or digital content is faulty, not as described or otherwise does not conform to the contract.
Where required by applicable law, Nova Code Matrix will provide an appropriate remedy, which may include technical assistance, correction, repair, replacement, price reduction or refund.
Software Licence and Use
Unless otherwise stated in the relevant product description, the customer receives a personal, non-exclusive and non-transferable licence to use the purchased Nova Code Matrix software.
The customer may not unlawfully copy, resell, redistribute, sublicense or make proprietary Nova Code Matrix software available to third parties.
Where a Nova Code Matrix product contains third-party or open-source software, those components remain subject to their respective licences. Nothing in these Terms restricts rights granted to the customer under an applicable open-source licence.
Financial Data and Comparisons
NovaCode Matrix provides software for factual financial data and comparisons. These products and services do not guarantee profits or particular financial results.
Investing involves risk and may result in partial or complete loss of capital. Past performance does not guarantee future results.
NovaCode Matrix provides information only, not investment advice or recommendations to buy or sell. Customers remain responsible for their own financial decisions.
Technical Support and Corrections
Nova Code Matrix may provide reasonable technical assistance for the installation and operation of its software. Where a verified software defect exists, Nova Code Matrix may provide technical assistance, a correction, patch, update or replacement, as appropriate.
Technical support does not cover problems caused by unauthorised modifications, incompatible third-party systems, incorrect customer configuration or third-party services, except where applicable law provides otherwise.
Third-Party Services
Nova Code Matrix software may interact with third-party data providers, SIP/VoIP providers, APIs or other external services. The availability, security and operation of such third-party services are outside the direct control of Nova Code Matrix.
Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law. Subject to applicable law, Nova Code Matrix and its operator are not responsible for investment losses resulting from market movements or decisions made by the customer. No statement or software function constitutes a guarantee of financial performance.
Intellectual Property
Nova Code Matrix branding, original website content, documentation and proprietary software components remain protected by applicable intellectual-property laws. Third-party and open-source components remain subject to their respective licences.
Applicable Law and Consumer Rights
These Terms are governed by applicable UK law. Nothing in these Terms removes or restricts mandatory consumer rights that apply to a customer under applicable law.
